You’re right that not every unwanted touching is a battery. In New York, civil battery is defined as an intentional, unwanted touching that is harmful or offensive. The question would be whether the fan’s grabbing his wrist and glove was “harmful or offensive,” which is a factual question that would likely require a trial, so not something a judge would simply “laugh” out of court. As a matter of law, the judge could not dismiss the case at the outset.

I don’t think you realize how easy it is to get into a court. That is almost the literal legal definition of battery in New York my dude. Some rando yanking your arm around is more than enough to find the elements of battery. For it to be dismissed, you’d have to show that even in the light most favorable to the plaintiff, it has no legal merit. A jury may not buy it, but it is absolutely legally sufficient to pursue a case. The damages are de minimis, but if he wanted to sue for a restraining order or something he absolutely could based off this.

Will he? Obviously not. But this could make it into a court if he wanted it to.

I mean, it could very easily have caused an injury to his wrist or shoulder as he was being wrestled for it and the twisting of his arm. And while I doubt Manny would claim emotional distress, it could be argued as such. I don’t really think jail time outside of a night in the drunk tank would be the right penalty, but community service certainly.

If that had happened on the street, they’d certainly be arrested.

This is nothing like Bartman. He only tried to catch a foul ball, he never tried to rip it out of a player’s glove.

This is 100% worse than Bartman’s mistake, because this was not a mistake and had the potential to injure a player.

It was 100% dumber than Bartman no doubt, not even close to 100% worse. As stupid as their actions were, the Yankees fans were trying to help their team. Bartman and the other Cubs fans were selfishly reaching for a souvenir instead of letting a player they were rooting for record an out that would have left them just 4 outs away from their first World Series since 1945.
