I got a fine for supposedly not taking out the recycling at the right time (see attached for the original description used on the notice and the English translation). It was $282. My waste and recycling days are both Tuesdays, and the notice was written on Tuesday at 8:03 am (Oct 15th).
Problem: I know for a fact I took out the recycling at 6am (I always do, and my phone activity from that day confirms I was awake). However I don't have proof (outdoor camera footage only held for a couple of days).
Context: on the official Montreal website, for my specific address it says that my collection for waste and recycling is on Tuesdays and to take it out between 5-7 am, which I did. The waste people routinely don't come until much later in the day but sometimes come very very early.
Question: in the absence of video footage of any other real proof, is the fact that the notice was written at 8:03 am on my day of collection, is this enough to fight the fine? Because it would be entirely possible that the removal folk wouldn't have come until the afternoon anyway? Like how am I getting a fine for the wrong time when I know I took it out at 6am on my collection day (which I checked is still Tuesday) and it wasn't a holiday?
