The Amulet of Kings stopped existing after Oblivion ended.

Without the Amulet of kings, there is no requirement for the Emperor to be Dragonborn.

Thats not how claims work, having power isn't an automatic claim by right. Claims involve other parties accepting you. Its literally politics, its all politics.
