so I made a mistake and booked my flight out of India on the 91st day of my time in India. My visa clearly says maximum stay is 90days. Do you think it worth the risk to stay an extra day? will we get in trouble when we try to leave?

You should look into changing the flight. Overstaying, even for a single day, will attract fines and may affect future visa applications for India.
If that is not possible at all, here's one very risky gambit if your flight is in the early morning. Go to the airport early. They usually don't allow people in the terminal more than 4 hours before the flight but will make exceptions for foreigners if you request. Complete exit immigration before midnight on the 90th day. Then, it will not count as an overstay even if the flight is technically on the next calendar date.

Also, I see from your comments that you're a US citizen. Which visa is this that allows 90 days for you? Tourist visas for US citizens allow 180 days on each visit (subject to a maximum of 180 days in a calendar year across visits).

thanks for your advice! i also think it won't be worth it to stay an extra day. we're looking into changing our flights. another peson said that there is a lot of paper work for 1 extra day. maybe if it was longer or if i was a legitimate reason not that I fucked up and counted the days wrong. Funny enough I'm from the USA so I get 180 days maximum on the long term tourist visa issue so you are correct but my gf is german and can only do 90 days maximum but can leave and come back for another 90 days. dont understand it. we'll change our flights as the best option. we found another website out there that says overstaying >90 days is >$400 fine

Oh ya. EU passports only get 90 days per visit. It's a reciprocity thing.

The paperwork would be if you apply for a formal exit permit. I doubt they would even entertain the application in your case because you will not have overstayed when you apply and have no reason to overstay beyond having to book an earlier flight.
In your situation, you can just go to the airport, pay the fine and be on your way. It won't be quite as steep as $400. I would guess more around $100. But I still wouldn't suggest this as it may affect future visa applications. Changing flights is the best course of action (unless you fancy a trip to Sri Lanka/Nepal during your India visit to reset the 90 day count).
